Relatives of Mull of Kintyre Chinook victims petition High Court for case revival

Families of the 29 people killed in the 1994 Mull of Kintyre Chinook crash are asking the High Court to approve a new legal challenge against the Ministry of Defence, citing unaddressed concerns about the aircraft’s safety.

Lawyers representing the Chinook Justice Campaign (CJC) have urged the High Court to allow a legal challenge regarding the 1994 RAF Chinook crash to proceed. The 1994 incident, which occurred in the Mull of Kintyre, Scotland, resulted in the deaths of 25 passengers and four crew members. Families of the victims argue that the Ministry of Defence (MoD) has failed to address critical concerns regarding the aircraft’s airworthiness.

The legal team contends that the victims were placed on a helicopter that was known to be unsafe, pointing to a history of mechanical deficiencies and a problematic upgrade process. Andy Tobias, whose father Lieutenant Colonel John Tobias MBE perished in the disaster, described the court proceedings as a significant milestone in their pursuit of answers. The families seek a new independent review, asserting that the government’s refusal to hold a public inquiry violates human rights obligations.

Conversely, the Ministry of Defence is contesting the bid, arguing that the claim is untimely and relies on unsubstantiated assertions. Counsel for the MoD, Daniel Beard KC, stated that previous investigations have been exhaustive and that the passage of time makes a new, meaningful inquiry unlikely. The MoD maintains that the issues raised, including prior litigation involving Boeing, are irrelevant to the specific causes of the 1994 crash.

The crash initially resulted in findings that blamed pilots Flight Lieutenant Rick Cook and Jonathan Tapper. While a 2011 review later cleared the pilots of wrongdoing, it failed to identify a definitive cause for the tragedy. The current High Court hearing aims to determine if the families’ request for further investigation possesses sufficient merit to continue.
