New regulations from the Equality and Human Rights Commission (EHRC) regarding single-sex facilities are now active across England, Wales, and Scotland. The code directs that public spaces like changing rooms and toilets should be designated by biological sex.
According to the guidance, transgender individuals are advised to utilize gender-neutral facilities or those corresponding to their biological sex in settings such as gyms or support centres. This rollout follows a UK Supreme Court decision asserting that “sex” under equality legislation refers to biological sex rather than gender identity.
The policy applies to a wide range of entities, including cafes, shelters, and public washrooms. While the EHRC notes that mandating services based on biological sex is permissible for privacy and safety, it also highlights that forcing trans individuals to use specific facilities could potentially constitute discrimination, positioning gender-neutral spaces as a viable alternative.
These updates have sparked significant debate. Advocacy groups for trans rights argue the measures are impractical and exclusionary. Conversely, organizations focused on sex-based rights maintain that the code offers necessary clarity for compliance with the 2010 Equality Act. Despite some parliamentary opposition, the guidance was finalized following a lack of formal debate in the legislature.
