The Delta State House of Assembly has officially declared the seat held by Hon. Collins Egbetamah, who represents the Udu State Constituency, vacant. This decision follows Egbetamah’s resignation from the All Progressives Congress (APC) and his subsequent transition to the Nigeria Democratic Congress (NDC).
This legislative action aligns with the constitutional provisions outlined in Section 109(1)(g) and (2) of the 1999 Constitution of the Federal Republic of Nigeria, as amended. The motion to vacate the seat was introduced by House Leader Hon. Emeka Nwaobi and received support from Deputy Speaker Hon. Arthur Akpowowo. The resolution was passed unanimously during a plenary session led by Speaker Hon. Emomotimi Guwor.
Speaker Guwor ordered the Clerk of the House to inform the Independent National Electoral Commission (INEC) of this development. Furthermore, the Speaker requested that the electoral body initiate the necessary procedures for a by-election to fill the resulting vacancy, as required by Section 116(2) of the Constitution. Hon. Nwaobi emphasized that evidence confirmed Egbetamah shifted his political allegiance while currently holding office, a move prohibited under Section 109(1)(g) unless specific constitutional exemptions apply. The House had previously reviewed Egbetamah’s formal resignation letter, dated June 19, 2026, which noted his departure from the APC on April 30, 2026.
