Mum Wins $11.3 Million Lawsuit Against Target After Parking Lot Fall
A mother who tripped and fell in a Target parking lot in Florida, U.S., and fractured several bones has been awarded $11.3 million by a jury after suing the retail giant.
The 44-year-old woman received $11,391,183.28 in damages after the fall at a Super Target in Winter Garden, an Orlando suburb, on December 23, 2019, during the busy holiday shopping rush, WFTV reported.
The jury recently announced the settlement in the case.
At the time of the accident, she was carrying her daughter through the Winter Garden Village shopping center, weaving between cars to avoid traffic and puddles.
While walking past a landscaping island, she tripped over a seam where the asphalt met the concrete gutter of the curb. The section of the parking lot had a sudden and dangerous elevation change, violating several building codes, according to the report.
Stepping on the uneven surface caused her left ankle to twist and fracture, sending her to the ground.
As she tried to steady herself without dropping her child, she ended up in a painful, pretzel-like position.
The awkward landing resulted in fractures to her right tibia, fibula, and lateral malleolus, the report stated.
The woman, who was represented by Morgan & Morgan attorneys Matt Morgan, Fan Li, and Perry Nava, had previously declined a pre-trial settlement offer of $250,000.
An Orange County jury found Target 90 percent at fault and awarded her the eight-figure payout on Friday, October 17.
