A Federal High Court located in Port Harcourt has thrown out a lawsuit brought by Legborsi Nwiabu, an African Democratic Congress aspirant for the Khana State Constituency I seat. Nwiabu had initially contested the selection of Bright Nulee as the party candidate for the Rivers State House of Assembly.
Justice Muhammed Turaki issued the dismissal after the plaintiff’s lawyer, Felix Beragbara, announced his client’s intention to drop the legal challenge against the ADC, Nulee, and the Independent National Electoral Commission. The decision followed mediation efforts led by the ADC’s Peace and Reconciliation Committee, which is directed by Emma Chindah.
While other defense lawyers did not object to the withdrawal, the representative for INEC requested court costs. Justice Turaki ultimately granted the request to dismiss the case and ordered the plaintiff to pay N50,000 to INEC.
Beragbara explained that Nwiabu chose to prioritize party unity over his individual goals. He noted that interventions from party leadership, including Board of Trustees Chairman Raph Nwosu and gubernatorial candidate Gabriel Pidomson, were instrumental in encouraging Nwiabu to resolve the conflict out of court.
