A coalition of four American human rights organizations has initiated legal action against the Trump administration, labeling recent sanctions against the International Criminal Court (ICC) as unlawful. The lawsuit, submitted to the Southern District of New York on August 11, involves the Open Society Institute, the Center for Constitutional Rights, Human Rights Watch, and the American Friends Service Committee.
The plaintiffs aim to overturn an executive order issued by President Donald Trump that targets ICC officials and associates. The groups contend that this policy disrupts essential international legal processes and constitutes an assault on the pursuit of justice. Furthermore, they argue that the sanctions violate the Fifth and First Amendments of the U.S. Constitution and the Religious Freedom Restoration Act.
Legal representatives for the coalition state that the administration overstepped its constitutional authority by fabricating a national emergency to justify these measures. Lead counsel Andrew Loewenstein remarked that the order improperly restricts human rights advocacy. Meanwhile, AFSC General Secretary Joyce Ajlouny characterized the sanctions as a direct intimidation tactic against those seeking accountability for genocide and war crimes.
The current sanctions list includes various ICC prosecutors and judges, as well as three Palestinian human rights organizations and the UN Special Rapporteur for the Palestinian Territory. Secretary of State Marco Rubio has publicly committed to dismantling the court, citing its attempts to investigate American personnel. The plaintiffs are now urging the court to void the order and restore protections for international judicial proceedings.
