USCIS Introduces New Immigration Fees Under H.R. 1, Effective July 22

The U.S. Citizenship and Immigration Services (USCIS) has announced revised and newly imposed fees for several immigration-related applications, in line with the H.R. 1 Reconciliation Bill. The updated fee structure will come into effect on July 22, 2025.

According to a Federal Register notice published on July 18, all immigration forms postmarked on or after July 22 must include the new fees. USCIS warned that any submissions lacking the correct payment would be rejected starting August 21.

Among the significant changes is a new $100 charge for Form I-589, used for asylum and withholding of removal applications. In addition, applicants with pending asylum cases must now pay a $100 Annual Asylum Fee (AAF) for every year their application is unresolved.

Fees for Form I-765, which covers Employment Authorization Document (EAD) requests, have also increased. The cost for an initial application is now $550, while renewals and extensions are set at $275. A separate $275 fee applies to EADs filed after the approval of re-parole via Form I-131.

Applicants filing Form I-360 under the Special Immigrant Juvenile category will now pay $250. Additionally, the registration fee for Temporary Protected Status (TPS) using Form I-821 has surged from $50 to $500.

USCIS clarified that these H.R. 1-mandated fees are statutory and cannot be waived, even for applicants normally eligible for fee waivers.

For asylum applications submitted after October 1, 2024, the AAF must be paid annually starting on the one-year anniversary of the filing date, and for each year thereafter, until a decision is reached.

The rule also shortens the validity of work permits. EADs granted to parolees will be valid for no more than one year or the duration of parole—whichever is shorter. TPS beneficiaries will receive EADs valid for up to one year or the term of their TPS designation.

USCIS noted that additional fee revisions for forms such as I-131 and I-102 will be announced in the near future.
