A Federal High Court in Asaba, Delta State, is currently reviewing a petition to annul the All Progressives Congress (APC) primary election for the Ndokwa/Ukwuani Federal Constituency, which took place on May 16, 2026. The legal challenge was initiated by Chukwuemeke Victor, an aspirant who claims the election of Nnamdi Ezechi as the party candidate was deeply flawed.
Represented by his lawyer, Evans Ufeli, Victor argues that the party violated the Electoral Act, the 1999 Constitution, and APC internal rules. His complaints include a lack of proper communication regarding election guidelines and venues, as well as the late notice given for the direct primary mode. Victor also highlighted issues such as insufficient accreditation, missing official result sheets for ward officers, and a lack of transparency during the final collation in Utagba-Uno.
As a result, the plaintiff has requested that the court order a fresh primary election. He also seeks an injunction to prevent the Independent National Electoral Commission (INEC) from recognizing Ezechi as the candidate and is pursuing ₦500 million in costs from Ossai Ossai.
In defense, Ezechi and other respondents have asked the court to dismiss the case. They contend the primary followed all necessary legal standards and party regulations. Ezechi reported receiving 20,097 votes, significantly ahead of his challengers. They further argue that the lawsuit is premature, as Victor failed to use the party’s internal grievance procedures, and they maintain the INEC monitoring report verifies that the process was orderly and credible.
