Anthony Fauci, the former White House chief medical adviser, is at risk of being held in contempt of Congress after declining to answer questions during a heated Senate hearing regarding his management of the Covid-19 pandemic. Throughout the session, the former infectious disease expert relied on the Fifth Amendment over 100 times, citing advice from his legal counsel.
Senator Rand Paul, who chairs the Senate Committee on Homeland Security and Governmental Affairs, suggested that prosecution is a distinct possibility. Paul has long alleged that Fauci obscured the origins of the virus and provided funding to research conducted at the Wuhan Institute of Virology. Fauci has consistently denied these claims. While invoking the Fifth Amendment is not a crime, the committee is scheduled to vote on a criminal contempt resolution next week.
Passage of such a resolution in the Senate would require a significant number of Democratic votes, making it a difficult hurdle. Furthermore, while President Joe Biden issued a broad pardon for Fauci’s actions between 2014 and 2025, legal experts note that actions taken after this window could still be subject to investigation. In a separate development, Florida’s attorney general has indicated an intent to launch an independent inquiry into the matter.
During the hearing, tensions flared as Republicans questioned the shift in health policies during the pandemic, while Democratic senators defended Fauci, describing the proceedings as an attempt to trap him. The debate over whether the virus emerged naturally or from a laboratory leak remains a point of significant contention, with the World Health Organization currently viewing the data as inconclusive.
