ADC candidate initiates legal action over primary election exclusion

ADC aspirant Legborsi Nwiabu has sued his party and INEC, challenging the legitimacy of the primary election that selected Bright Nulee as the candidate for the Khana Constituency I seat.

Legborsi Nwiabu, a hopeful representing the African Democratic Congress (ADC) for the Rivers State House of Assembly in Khana Constituency I, has filed a lawsuit at the Federal High Court in Port Harcourt. Nwiabu claims he was unfairly barred from participating in his party’s recent primary election. The legal action also includes the ADC’s chosen candidate, Bright Nulee, and the Independent National Electoral Commission (INEC) as respondents.

During Friday’s court proceedings, ADC attorney Emenike Ebete requested an adjournment to explore an out-of-court settlement, noting that a committee was formed to address the election dispute. While the other respondents agreed, Nwiabu’s lawyer, Felix Beragbara, objected, stating his client was unaware of any such committee. Justice Muhammed Turaki ultimately approved the request and rescheduled the hearing for August 12, 2026.

Beragbara explained that Nwiabu was sidelined despite being prepared for the May 2026 primaries. He alleged that after the initial date was moved to May 22, Nwiabu deployed agents across all 11 wards of Khana Constituency I, but no officials arrived to conduct the voting. Nwiabu argues that the party bypassed the democratic process entirely by declaring Nulee the candidate without holding an election, prompting him to seek judicial intervention.
