Diddy’s Legal Team Files New Bail Motion

Sean “Diddy” Combs is seeking release from jail ahead of his October 3 sentencing, with his legal team filing a renewed motion for bail, arguing his pre-sentencing detention is unjustified and disproportionate.

In a filing submitted to Judge Arun Subramanian, attorneys Marc Agnifilo and Teny Geragos contend that Diddy is the only individual in the U.S. currently incarcerated for hiring male sex workers to engage in sexual activity with his partner. They argue his conviction under the Mann Act — a century-old law that criminalizes the transport of individuals across state lines for illegal sexual conduct — should not necessitate continued detention.

The documents, obtained by TMZ, point out that most Mann Act convictions do not lead to pre-sentencing incarceration. Diddy was convicted of two violations under the Act but acquitted of more severe charges, including racketeering conspiracy and sex trafficking.

His legal team maintains the case involved consensual relationships among adults and that Diddy never personally engaged in sex acts with the escorts. They argue that the application of the Mann Act in this case is outdated, given evolving norms surrounding adult relationships and sexual behavior.

Diddy was previously denied bail after the court expressed concerns about public safety, citing past violent behavior — notably a resurfaced 2016 video showing him assaulting his then-partner, Cassie. The judge concluded that his release could pose a danger to the community.

In the latest motion, Diddy’s attorneys admit the 2016 incident occurred but stress that since 2018 he has shown no consistent pattern of violence, aside from a disputed altercation in June 2024 involving another woman, Jane, which the defense claims was provoked.

To support the bail request, Diddy’s team has proposed a $50 million bond secured by his Florida estate, with guarantees from three financially reliable individuals. Additional proposed conditions include home detention, electronic monitoring, mental health and substance abuse treatment, forfeiture of his passport, and restricted travel within the Southern Districts of Florida and New York under federal supervision.

The court has yet to issue a ruling, while prosecutors have maintained their opposition to granting bail.
