The Federal High Court in Dutse has validated the All Progressives Congress (APC) primary election for the Hadejia/Auyo/Kafin Hausa Federal Constituency in Jigawa State. This decision confirms Aliyu Hussaini Usaini Jabo as the party’s official candidate.
The legal challenge was initiated by Ishaq El-Yakubu Nabayi, an aspirant who disputed the June 2026 primary results. He alleged that electoral malpractice and irregularities compromised the process in three wards.
Justice Muhammad Ibrahim dismissed the case, citing a lack of jurisdiction. The court determined the lawsuit was incompetent because it was filed past the 14-day statutory deadline for pre-election disputes. Furthermore, the judge noted the plaintiff neglected to submit a mandatory affidavit regarding potential multiple lawsuits. Consequently, the court ordered the plaintiff to pay N5 million in costs to the APC, Aliyu Hussaini Usaini Jabo, and the Independent National Electoral Commission (INEC).
Defence counsel Abdul Adam, SAN, confirmed that the court supported their preliminary objection regarding the timeline. Barrister Baffa Alhassan, representing the APC, reiterated that the court confirmed Jabo as the legitimate nominee after concluding that the legal action did not meet constitutional requirements for timeliness.
