An overview of the five primary employment-based visa categories for foreign nationals looking to secure permanent residency in the United States.

Each fiscal year, spanning from October 1 to September 30, the United States allocates roughly 140,000 immigrant visas tied to employment. These visas are organized into five distinct tiers, allowing qualified foreign workers to bring along eligible family members.

The first tier, E1, is reserved for priority workers and those with exceptional talent. This includes high achievers in science, arts, education, business, or athletics, alongside renowned professors and multinational business leaders. While some exceptional individuals can self-petition, others require specific job offers.

The E2 category targets professionals holding advanced degrees or individuals demonstrating exceptional ability. Typically, these candidates need a job offer and a labor certification, though a National Interest Waiver can sometimes bypass these prerequisites.

E3 visas serve skilled workers, professionals, and those in roles requiring less than two years of experience. This route usually necessitates a job offer and approval from the Department of Labor.

The E4 designation covers special immigrant groups, including religious workers, former government employees, and specific translators. Unlike most other categories, these applicants do not need labor certification.

Finally, the E5 preference is tailored for international investors. These individuals must invest capital into new American businesses that actively generate jobs.
